These Terms & Conditions (“Terms”) govern your purchase and use of digital eBooks, online courses, educational materials, downloadable resources, consulting resources, and related products and services (“Products”) offered by Liberty with Amanda (“Liberty with Amanda,” “we,” “us,” or “our”) through AmandaHughes.US (the “Website”).
By purchasing, accessing, downloading, or using any Product, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not purchase, access, download, or use our Products.
When you purchase an eBook, online course, digital resource, training material, or other Product from Liberty with Amanda, you are purchasing a limited license to access and use the Product for your personal, non-commercial educational purposes.
Your purchase does not transfer ownership of the Product, copyright, trademark rights, or other intellectual-property rights to you.
An eBook purchase provides access to the digital publication in the format specified at the time of purchase.
An online-course purchase provides access to the course content specifically identified as included with that course, which may include videos, written materials, worksheets, downloadable resources, presentations, and other educational materials.
We reserve the right to update, revise, replace, or improve course content and educational materials from time to time.
Upon successful payment, Liberty with Amanda grants you a limited, non-exclusive, non-transferable, revocable license to access and use the purchased Product for your own personal, non-commercial educational purposes.
This license does not constitute a sale or transfer of copyright or ownership of the underlying intellectual property.

You may not use the Product to create a competing course, publication, training program, presentation, commercial service, or substantially similar product without prior written permission from Liberty with Amanda.
Unless a separate written license has been purchased, each Product is licensed to one individual purchaser.

If you would like to use a Product for a classroom, school, organization, church, nonprofit, business, political organization, or other group, please contact Liberty with Amanda regarding an appropriate group or organizational license.
You may not distribute, reproduce, publish, upload, transmit, email, post, sell, or otherwise make any Product available to another person without prior written authorization from Liberty with Amanda.
Unauthorized redistribution includes sharing Products through:
A Product may not be shared simply because the recipient is a friend, family member, coworker, church member, colleague, or member of an organization.
Each person who wishes to access a Product must obtain an appropriate license.
You may not sell, resell, sublicense, rent, lease, barter, auction, or otherwise commercially transfer any Product or access to any Product.
You may not purchase a Product for the purpose of reselling, redistributing, or commercially distributing it to another person or organization.
You may not incorporate substantial portions of our Products into another product, course, publication, training program, or service that you sell or distribute.
If a Product requires an account, username, password, or other login credentials, those credentials are personal to the purchaser.

Liberty with Amanda may monitor account activity when reasonably necessary to protect its Products, customers, platform, and intellectual property.
If we reasonably determine that an account is being shared or improperly accessed, we may suspend or terminate access without refund, subject to applicable law.
All Products and their contents—including, without limitation:
are owned by or licensed to Liberty with Amanda and are protected by applicable copyright, trademark, and other intellectual-property laws.
Your purchase grants you a limited license to use the Product. It does not transfer ownership of the underlying intellectual property to you.
You may not reproduce, distribute, publicly display, publish, modify, create derivative works from, or commercially exploit our copyrighted materials except as expressly permitted by these Terms or by written permission.
Unless otherwise expressly stated for a particular Product, purchased online courses include lifetime access.
For purposes of these Terms, “lifetime access” means access for the commercially reasonable lifetime of the course and the platform through which the course is provided. It does not guarantee that a specific third-party technology platform will remain available indefinitely.
Liberty with Amanda may update, revise, improve, replace, or reorganize course content.
If Liberty with Amanda permanently discontinues a course for legitimate business reasons, we will make reasonable efforts to provide purchasers with substantially similar access or another reasonable solution, subject to applicable law.
Lifetime access does not mean that additional courses, future products, future editions, or new materials automatically become included in your purchase unless expressly stated.
Liberty with Amanda reserves the right to suspend or terminate your account or Product access if you:
Where appropriate, we may provide notice and an opportunity to correct a violation.
Termination resulting from your material violation of these Terms may result in loss of Product access without a refund, to the extent permitted by law.
Sections concerning intellectual property, restrictions, disclaimers, limitations of liability, governing law, and dispute resolution survive termination.
Liberty with Amanda offers a 30-day satisfaction guarantee on eligible online courses.
If you are not satisfied with an eligible course, you may request a refund within 30 calendar days of the original purchase date.

Approved refunds will generally be issued to the original payment method.
The 30-day guarantee applies only to the original purchaser and original purchase. It does not apply to unauthorized users or individuals who received access through unauthorized sharing.
Refunds do not reinstate or extend after a refund has been issued. Once a refund is processed, your license and access to the refunded Product will terminate.
Nothing in this policy limits any non-waivable rights or remedies provided by applicable law.
Liberty with Amanda does not currently offer subscriptions, recurring memberships, or installment payment plans.
Products are purchased through a one-time payment unless otherwise expressly stated at the time of purchase.
Because there are no recurring subscriptions or installment plans, there are no recurring charges to cancel.
If a Product is eligible for the 30-day satisfaction guarantee described in Section 10, the customer may request a refund within the applicable 30-day period.
All Products offered by Liberty with Amanda are provided for educational and informational purposes only.
Our Products are designed to provide educational information, perspectives, resources, and general guidance concerning subjects such as education, American history, civics, government, constitutional principles, school-board issues, parental involvement, and related topics.
Nothing contained in our Products constitutes individualized:
You are responsible for determining how information provided through our Products applies to your individual circumstances.
You should consult an appropriately qualified professional when you need individualized legal, financial, medical, educational, or other professional advice.
Liberty with Amanda does not guarantee any particular outcome, including any particular school-board, educational, political, business, organizational, financial, or other result.
Opinions expressed in educational materials are provided for informational and educational purposes and do not necessarily constitute legal or professional advice.
To the fullest extent permitted by applicable law, Liberty with Amanda, its owner, contractors, affiliates, licensors, service providers, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your purchase, access to, or use of any Product or the Website.
To the fullest extent permitted by law, the total aggregate liability of Liberty with Amanda arising out of or relating to a Product shall not exceed the amount you actually paid for that Product.
You acknowledge that educational Products are provided for informational purposes and that you are responsible for your own decisions, actions, and results.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict-of-law principles.
To the fullest extent permitted by law, any legal action or proceeding arising out of or relating to these Terms, the Website, or your purchase or use of a Product shall be brought in the state or federal courts located in Kittson County, Minnesota, or another court of competent jurisdiction as required by applicable law.
You consent to the jurisdiction and venue of such courts to the extent permitted by law.

The parties agree to make a good-faith effort to resolve the matter informally.
If the dispute cannot be resolved informally, either party may pursue remedies available under applicable Minnesota law.
The parties may mutually agree to participate in mediation before pursuing litigation. Any mediation shall take place in Minnesota unless the parties agree otherwise.
Nothing in this section prevents a consumer from exercising rights that cannot legally be waived or restricted.

Liberty with Amanda may update these Terms from time to time.
Updated Terms will be posted on the Website with a revised “Last Updated” date.
Changes will generally apply prospectively. Your continued use of the Website or Products after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be modified or severed to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with any applicable Product description, purchase terms, refund policy, Privacy Policy, and other agreements expressly incorporated by reference, constitute the entire agreement between you and Liberty with Amanda concerning your purchase and use of the Products.
